On Thomas’ dissent joined by Alito: Here’s the dissent from January cited. IMO it’s a reasonable academic dispute but advances form over substance. To not simply deny it would encourage frivolous filings. Paxton was not the State. He is a public official under investigation trolling for an illegal pardon as a bribe.
